Action by the plaintiffs Katherine Schiro and her husband, Mike Schiro, to recover damages from the defendant Oriental Realty
Company arising out of personal injuries sustained by Mrs. Schiro as a result of a fall. The plaintiffs and defendant are adjoining landowners in the city of Milwaukee, the east boundary of plaintiffs' premises
forming the west boundary of defendant's property. The elevation of the plaintiffs' land is approximately 30 inches higher
than that of defendant's lot. Plaintiffs acquired title to their premises in 1926 and ever since have resided in the dwelling
house situated thereon. At the time they purchased such property there was a concrete retaining wall 8 inches wide erected
on defendant's lot which held plaintiffs' adjoining land in place. Such retaining wall is approximately 7 1/2 feet east of
the east wall of plaintiffs' house. A 2 foot wide board sidewalk running generally parallel with the wall is located between
plaintiffs' house and the wall so as to leave a narrow strip of lawn, which strip varied in width from 15 to 20 inches between
the east edge of the sidewalk and the top of the wall on the day of the accident. Four clothes poles with wooden cross-arms
at the top were erected on this narrow strip, to which cross-arms clothes lines were strung on wash days.
